Application by RSPCA - they do not want to produce Geraldine's documents seized on the 22nd February 2008 or the video taken by Imagination Television to the Court and any other evidence. Application failed as he Geraldine Robertson's Application for the return of all her records and property was too vague - Geraldine Robertson does not get any of her records back.

RSPCA have still not provided brief of evidence and are still holding onto all the documents and property seized on 22 Feb 2008. RSPCA seized all of Geraldine's evidence she needs to defend her self and are refusing to give it back to her. They told the Courts they have but this is not true. (only a very small portion (10%) has been returned as photocopies.

At this hearing RSPCA did not turn up. The Magistrate acted as Prosecutor and Magistrate. The Magistrate would not allow me to have any help at the bar table taking notes and helping with documents. RSPCA still do not have a brief of evidence together so say they cannot prosecute the charges. 16 months is not enough time for them. (I am beginning to fear that this court is biased against me. Magistrate acting as Prosecutor and Magistrate is an indication that something is wrong, and the way the RSPCA were not called indicates private conferencing and favours. RSPCA are still holding onto all my evidence and business records seized from me on the 22nd February 2008. How long does one have to be put out of business waiting for a court hearing? How long was the waiting has to go on for?)

Geraldine Robertson had an application before the Court that RSPCA return specifically her kennel boarding card records seized on 22 Feb 2008. These records contained the names of witnesses who had been to her kennels and placed their dogs into her kennels or retrieved their dogs from the kennels in the months, weeks & days before seizure. 

Anthony Deane of Clayton Utz said RSPCA does not have these records. It is inconceivable that these records, so important to the Defendant, now no longer exist.  The Defendant was denied Natural Justice when RSPCA seized her records needed for her defence and the Court not only ignores this act but condones it. Dean for Clayton Utz produced an affidavit with photos which clearly show these kennel card records were in existence and were seized by RSPCA on 22 Feb 2008.

Geraldine Roberts received an order for costs of $250.00 for Clayton Utz's legal fees for wanting her boarding card records back.

Geraldine Robertson found guilty of Four Charges. There was not a hearing set down for this day. This conviction is now being Appealed to the District Court.  Geradine Robertson received a notice of conviction for animal cruelty with a fine of $250.00. This is a recorded conviction and because of this conviction Geraldine Robertson's Appeal to to the District Court against Magistrate Strofield's order could not succeed.

Geraldine Robertson has appealed this conviction to the Beenleigh District Court. Hearing in District Court on 21 Sept 09.

Another mention - Magistrate T Morgan tried to cheat Geraldine Robertson when he said the conviction was a clerical error and Geraldine Robertson could tear it up, indicating an Appeal was not necessary. Clayton Utz wrote saying the Appeal was incompetent and should be abandoned. Geraldine Robertson has been placed under undue pressure to abandon her appeal and let the recorded conviction stand, thus having her Appeal to the District Court Brisbane against Magistrate Strofield's order ambushed. She would not be able to get her dogs back. Section 222 (2) (b) Justices Act states that she has a right to Appeal regardless. Magistrate T Morgan said he would fix it but he did not record any order because the only way to fix a conviction, even a clerical error, is to appeal it. Magistrate T Morgan did not have Jurisdiction to fix this conviction.

Geraldine Robertson was given another penalty of $250.00 from the hearing of the 3 July 09. Twice for the same Application for the return of her boarding kennel cards. See this Notice of Conviction or Order. Have our Courts gone "mad"?

Hearing in Beenleigh District Court. Clayton Utz for RSPCA wrote to the Beenleigh District Court seeking the Appeal be struck out as incompetent. This means Geraldine Robertson would have 4 x guilty verdicts stand on the record when she has pleaded not guilty, there was no hearing on this date and she was absent from the Court. Read how this happened

Mention re: remainder of the charges 149 - 4 = 145 left?????? There was only 105 dogs seizedl??? There were puppies born since this date making a total of 149 dogs counting those unborn puppies at seizure on 9th Jan 2008.
