Dear Members of the Public and fellow Australians,

I write to seek your help and your wisdom. If after you have read the following and after you have done your own research, you still believe the contents of RSPCA media releases whom most of you have been shocked and disgusted to read or hear about the “uncovered cruelty” by others to animals, you are unwittingly assisting and abetting dishonesty and lies. You have been supporting an organisation, established since 1826, we all believed is still a charity. We are incorrect! Since 23/12/1999, RSPCA Australia became a business and since 2001 had been causing a lot of harm to innocent elderly people as well as cheating and stealing from the public in what they call “donations”.

 These are the facts:-

1.      RSPCA, an agent[1], delegated policing powers with its inspectors acting for the State of Queensland without proper controlled supervision, was and is acting in its own interests and abusing the due processes of the courts:

a.       RSPCA is a business trading in pets[2] [3] [4] and a competitor to all breeders in the pet market.

b.      RSPCA is an Agent[5] of the State Government delegated policing powers under an Act of Parliament[6] with conflicts of interests in:

                                                   i.      Its duty under the Act;

                                                 ii.      Its interests in trading profits from the sale of pets; 

                                                iii.      Donations from the public;

                                               iv.      Publicity to gain support from the public. RSPCA Annual Report 2008 reported $3million spent on advertising;

c.       RSPCA is not a unit of public administration. RSPCA cannot be supervised under the Crimes and Misconduct Act 2001[7] [8];

d.      Section 51 Trade Practices Act 1974[9] prohibits supervision of RSPCA by the Australian Competition and Consumer Commission[10]; 

e.       The Police cannot investigate RSPCA acting under an Act of Parliament;

This means that since 23 December 1999, the crimes and misconduct of RSPCA were not and will not be investigated under the current arrangement

2.      It is my belief that you by continuing to publish and support RSPCA media releases, would be further supporting and condoning the following misconduct by RSPCA contrary to the provisions and intent of the ACPA[11] and the Agreement[12] between DEEDI (DPI&F) and RSPCA with remuneration (your taxes) as agents for DPI&F:

a.       Seizing from owners and breeders valuable stock and other valuable property for RSPCA profit thus abusing its powers under the ACPA and Agreement;

b.      Prosecuting the previous owners for profit with publicity to deceive the public;

c.       Inciting the community to vilify the previous owners for publicity deceiving the public to raise donations for its own benefit;

d.      Inciting violence and public condemnation of the previous owners causing them mental and physical stress;

e.       Scaring away the previous owners’ witnesses;

f.        Hardening the resolve of its own witnesses;

g.       The seizure of personal, private and business records, witnesses contact details and removing those witnesses from the previous owners;

h.       Personally contacting witnesses to vilify the previous owners;

i.         Deliberately causing attrition with illegal negotiations with the previous owners’ lawyers;

j.        Putting forward fabricated evidence into the courts;

k.      Putting forward perjured evidence into the courts;

l.         Withholding vital evidence from the courts;

m.     Abusing its powers under the ACPA and its Agreement with DEEDI with threats to put the previous owners out of business;

n.       Persuading DEEDI to “sign off”  (formally forfeit)[13] all seized animals to RSPCA;

o.      Persuading DEEDI and the courts to ignore its misconduct, resulting in both DEEDI and the courts tacitly supporting by not allowing the relevant facts and laws into evidence;

p.      Persuading the courts to condone and allow RSPCA (through its lack of controlled supervision, conflict of duties and interests) under its Agreement to DEEDI to administer an Act of Parliament without any proper and controlled supervision and accountability to be a party to appeals against forfeitures, is not pursuant to the ACPA;

q.      Persuading both DEEDI and the courts to ignore the breaches of law and of its Agreement with DEEDI is not pursuant to the ACPA.

3.      Without proper controlled supervision RSPCA is able to and has seized properties from its competitors with the claims that:

a.       The properties were not properly cared for;

b.      Sell (“foster” deceitful usage of a word) for a sum of monies that property for its own profit; while,

c.       Taking every thing else from the previous owner with shelter charges[14], legal fees (RSPCA prosecutes for its own benefits) and penalty fees[15].

RSPCA, as a party to any court hearings regarding decisions by DEEDI on forfeiture of animals, has usurped the Administration of an Act of Parliament supported by both DEEDI and the courts. RSPCA abuses of its implied massive powers are not accountable to any institution, government, courts or the public for its actions to date.

I appeal to your common sense and cease to support such an evil business organisation - RSPCA who has total support from all the animals fanatics now calling themselves members of the “Voiceless” organisation who have for many years now infiltrated into Government and the courts enforcing their narrow views on all of us. Perhaps we should support a Democratic method of election for all our magistrates, judges, etc… like they do in USA?

Contrary to RSPCA claims, both my deceased husband Neil and I were retired professional Electrical and Mechanical Engineer and Accountant and we never lived off our beloved poodles and in fact it was our passion to perpetuate the quality of the breed. We were the only Australian Poodle Breeder who had exported to show and breeding kennels all over the world. We only bred to orders. Our beloved poodles have excellent temperaments, bred conformation and obedience champions internationally as well as nationally. RSPCA had destroyed the pedigrees and identities of all our poodles with their many generations of monitored, tested and controlled breeding as well as murdered our oldies through RSPCA real cruelty during and after seizure. I look forward to your assistance by circulating the above contents to one and sundry, protest to your local member of Parliament, discuss this amongst your mates and others, etc.. We need to contribute to the integrity of the laws and management of our beloved State and Country Australia. In case you have not noticed, we are rapidly becoming a “Fascist Country”, no longer a democracy.
