RSPCA seized Geraldine Robertson's World Famous Pedigreed Neiger Poodles worth $5million on the 9 Jan 2008. The Queensland Department of Primary Industries (DPI) forfeited her dogs to RSPCA for RSPCA to sell for their own profit. Geraldine Robertson appealed the forfeiture decision to the Brisbane Magistrates Court. Magistrate Strofield dismissed her Appeal in his decision meaning he would not order that her dogs be given back to her. Geraldine Robertson has Appealed this decision to the Brisbane District Court. Geraldine Robertson's Appeal relies on Natural Justice in that she was not given a fair hearing in the Magistrates Court. There are many grounds including the effects of pretrial publicity, the effects of the seizure of her personal property and records, the interference of her own witnesses, the scaring away of other witnesses, the effects of the pretrial publicity on witnesses, fabrication of evidence, perjury etc. See the evidence.

Geraldine Robertson in December 2008 was charged with 149 Animal offences in lieu of the 109 dogs (organised pregnant poodles, oldies, and new born puppies) by RSPCA in the Beenleigh Magistrates Court. RSPCA staff reported 8 pedigreed poodles were sold to Sue Graham of the Poodle Club of Qld and shipped out immediately after RSPCA vet checked and 40 pedigreed poodles were shipped to 3 locations north of Brisbane was also said by Nanda Ten, Manager of RSPCA shelter at Fairfield who was also videoed taking home with her that afternoon 3 black poodle puppies (which RSPCA vets had sworn died 3 weeks later from worms etc...) and the whelping and weaning of a litter of brown standard poodles in her home. Nanda Ten sworn in at the Brisbane Magistrates Court also said she had nothing to do with any dogs seized. RSPCA Inspectors, vets and DPI executive qualified in law and was employed by DPP prior to DPI, all sworn at Brisbane Magistrates Court that it did not rain and the wet concrete with bits of flood debris on the concrete were faeces and urine.

If Geraldine Robertson had been found guilty of animal cruelty and breach of her duty of care to her animals no District Court Judge could give her dogs back to her. Geraldine Robertson received an Advice of Conviction or order that was sufficient to cause the Brisbane District Court Judge to be unable to give her dogs back to her. This notice says 4 charges (out of 149 charges) were dealt with and the guilty penalty was $250.00, no conviction recorded when in fact, the prosecution was not even started. It is now recorded by the Queensland Government that Geraldine Robertson is Guilty of Animal cruelty and Breach of duty of care.

Geraldine Robertson made an Application to the Beenleigh Magistrates Court for the return of her kennel records which was heard on the 3 July 2009. These kennel records contain the contact details of boarding customers who had been to her kennels and seen her kennels when they put their dogs into her kennels and fetched their dogs from her kennels prior to the seizure of Geraldine Robertson's dogs on the 9th January 2008. The Christmas/New year period is a high demand time for boarding. The seizure of Geraldine Robertson's kennel records has cause her to lose her witnesses. Geraldine Robertson's application was denied by Magistrate White and Geraldine Robertson was ordered to pay $250.00 costs to RSPCA.

Geraldine Robertson knew something was wrong when she received a State Penalties Enforcement Agency Notice with an order date of the 6/7/2009. Geraldine Robertson went to the Beenleigh Magistrates Court Registry to explain that the Costs order is a civil debt, not a penalty, and Geraldine Robertson was ignored. The Registry staff were "bloody minded" and said this was normal and that it was for professional costs - deceptive and misleading conduct by that staff.

Geraldine Robertson filed an appeal to the Beenleigh District Court against the conviction notice. The Justices Act 222 (2) (b) allows appeals against costs penalties. Magistrate Morgan at the Beenleigh Magistrates Court on the 7th August 2009 told Geraldine Robertson to ignore the notice of conviction or order, he said, "you can tear it up", "throw it out". RSPCA lawyer said the appeal was incompetent and would fail with a massive costs order against Geraldine Robertson.

On the 2/09/2009 Geraldine Robertson received another Advice of Conviction or Order that on the face of it appeared to fix the problem of the guilty verdict, but this was a deception. On closer examination of the Order numbers Geraldine Robertson realised she now had two penalties of $250.00 each, totaling $500.00 for the "offence" of wanting her boarding kennel cards returned to her so she could find her witnesses. There should not have been any penalties at all, it was a lawyer's costs order, a civil debt, not a criminal penalty.

Because of the unreasonableness of the Beenleigh Magistrates Court registry and Mr Deane of Clayton Utz for RSPCA Geraldine Robertson appealed this second penalty to the Beenleigh District Court.

This matter was heard in the Beenleigh District Court on the 21 September 2009. Geraldine Robertson had provided the Court and Mr Anthony J. Deane for RSPCA an Outline of Argument where it was clearly explained how this guilty finding came about designed to cost her, her dogs in the Brisbane District Court when she wins her Appeal if she had two criminal penalties totaling $500.00 that should not have existed at all.

This matter is now being remedied by the District Court Judge who ordered the transcripts of the District Court hearing being mailed to Geraldine Robertson for her production in the Brisbane District Court Appeal for the return of her dogs should this fraud be persisted with.

With reference to Geraldine Robertson v Department of Primary Industries & RSPCA, and the Judgment handed down on Friday 24 July 2009, Court 32, Time: 9:00 am by Magistrate Strofield.
At this hearing Magistrate Strofield dismissed Geraldine Robertson's Appeal for the return of her dogs illegally seized by RSPCA.and confirmed forfeiture ordering $5 million of valuable pedigreed poodles from 20 years of controlled breeding to be sold.

The former Mayor of Beaudesert Shire Council wrote:
"........AS an outsider looking in, it appears to me to be dreadfully unfair on any boarding/breeding establishment to send in the RSPCA to collect animals during the very worst flooding in nearly twenty years when half the old 8eaudesert Shire was flooded including this property in early January,2008. I do not have access to any documents being no longer an elected member of Beaudesert Shire Council. ..however the situation of Geraldine Robertson was always a source of great disappointment to me as it always seemed to be of a vindictive nature - maybe professional jealousy? Yours faithfully, Joy Drescher ,former Mayor of Beaudesert Shire Council 1997 - 2000 and 2004 2008"

Anna Bligh is now funding her Administration by prosecuting for profit which is now firmly entrenched. Every person - fisherman, farmer, small business owners should be terrified as this Policy can take your stock, homes, boats, trucks, health, safety, security, freedom, everything imaginable from YOU - especially your right to litigate in the Courts for compensation. This is real and based on actual facts most of it was proven using 3rd party unbiased witnesses and proving the lies of RSPCA witnesses with their own evidence and their sworn statements that what they claimed cannot possibly be true. Dr Rick Symond the Bligh Goverment Animal Welfare Manager Qld and Mandy Symond his spouse a lawyer with RSPCA are both highly active members of Voiceless.

Anna Bligh has "rubber stamped" RSPCA to prosecute for profit to fund their administration of the Animal Care and Protection Act for Anna Bligh's Government. Under Anna Bligh's Labor Government, RSPCA have the supreme powers of Parliament and are untouchable. All pets seized by RSPCA are formally forfeited to RSPCA for RSPCA profit.

Anna Bligh's Government now has another contract with RSPCA refined to cover blatant funding by Government of $14/day paid for every dog seized. Announcement of this was by Dr Rick Symond BaVS. RSPCA is now working with Shire Councils and continue to do what they did to Geraldine Robertson to other breeders with a more refined approach i.e. gives the victim or target 14 days notice of a compliance order and return on the 15 day not to inspect if the direction was carried out but armed with a warrant to seize all dogs. The discussions overlooked (most discussions were deleted by RSPCA) in the electronic voice tape of the inspectors at Geraldine' Robertson seizure confirmed their current actions.

The Power of RSPCA is shown in the courts and in the media where RSPCA lies and heresay evidence are facts and provable lies assured as will be taken into consideration in the courts but given a big miss if not already deleted. Judges, magistrates and clerks of courts should not be allowed to have access to enable tampering of the recordings. The alleged audit and security control is really non existing. It would pay to hire a short hand recorder for the courts if you ever need to attend as the victim or defendant or applicant for your own safety. Signs all over the courts advices you are not allowed to electronically tape proceedings. You do not need to wonder why anymore.

On the 2 Oct 2009 Geraldine Robertson is in the Brisbane Supreme Court - Court of Appeal to argue why her Statement of Claim for damages should not have been struck out. All interested people should attend this open court and hearing to see it for yourself. According to the laws and cases tested before the courts, the Claim should not be struck out, but it was.

Annette Barrell, who so bravely supported Geraldine Robertson, has been very ill from stress from harassment by RSPCA who caused her to make the ultimate decision over her dogs.

Geraldine Robertson's witness, Annette Barrell had 30 valuable and in high demand pedigreed teacup poodles, she had bred for the past 20+ years. After a visit from RSPCA Inspector Travis Cooper she feared RSPCA was coming with a warrant to seize all her dogs. To avoid losing her home and everything from the prosecution, she had most of her poodles euthanased and others were re-homed. Disposing of her top quality dogs was the cheapest option, the alternative was to be attacked like Geraldine Robertson was.

Yes RSPCA Inspector Travis Cooper did attend with a warrant on the 15 Sept 2009 to seize all Annette Barrell's healthy dogs. RSPCA are doing it again but with deadly blatant precision. NOTE: Wondai, South Burnett seizure of 260 healthy breeding dogs, plus others. Anna Bligh has rubber stamped RSPCA's prosecutions for profit.

Geraldine Robertson expects RSPCA to again come to her property and again seize property including her computer system and legal files to again ambush her ongoing legal cases in Court. RSPCA did precisely this on the 22 Feb 2008. This is highly possible as Bligh's Government is giving RSPCA their total support to prosecute for profit.

Geraldine Robertson cannot forget and it will always haunt her, the atrocious behaviour of the RSPCA Inspectors on 9 January 2008, who chocked her sweet innocent poodles with tight martingale leads until the dog's eyes blanked out and tongues turned blue whilst they were dragged out to be shove into an 8 dog trailer and 2 Shire Council vehicles all her 104 dogs included many pregnant bitches on 9 January 2008. She saw them jammed in shivering, vomiting, drooling, defeacating and urinating out of pure fear. They could not moved jammed in together, standard and toy poodles.

Videos footages taken illegally by trespassers from 9.27am to 4.40pm became less than 30 minutes of actual and mostly fabricated evidence with malicious lies were released to the medias. Eight (8) poodles were sold immediately to a member of the Poodle Club of Qld Inc after vet check on arrival to RSPCA shelter at Fairfield. Forty (40) poodles were shipped out to 3 locations north of Brisbane. Poodle Club members were waiting to clip the poodles and film footages were released from about 10 January 2008 to all media and published with vicious lies provided by RSPCA.

The vicious postings on internet forums are posted by RSPCA and Voiceless employees, volunteers and supporters. These postings are designed to incite violence e.g. "beat her to death".

Professional staff of RSPCA i.e. Veterinarians, Lawyers were proven liars in the Brisbane Magistrate Court. Read it yourself their 99.99% correct vet records. Anthony J Deane (Clayton Utz) at the witness box saying......"it may incriminate myself", and negotiating with Geraldine Robertson's lawyers to surrender all her dogs without prosecution for her. RSPCA did not have the authority to negotiate at all. The Government controls the practicing Certificates of all Veterinarians and provides assistance to farmers with Dr Rick Symond as Animal Welfare Manager? What chances do farmers have for a fair go?

2. Friday 2 October 2009 Court of Appeal, on application of RSPCA to strike out Appeal to the Court of Appeal, an appeal against the strike out of her Supreme Court Claim against RSPCA and others.

Every Queenslander should be terrified of Anna Bligh. She has her Labor Government and it's agents prosecute any one of us for profit.

It happened to Geraldine Robertson a ordinary respectable citizen who is now damnified by RSPCA with the Anna Bligh's Labor Government full support.
